These Terms of Service (“Terms”) govern your use of artinsight.org (the “Site”) operated by ArtInsight LLC (“ArtInsight”, “we”, “us”), located at 15 Tumanyan Street, Yerevan 0002, Republic of Armenia. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About ArtInsight and Our Role

ArtInsight is a curated platform for contemporary Armenian art. We act as an intermediary that connects artists with buyers, renters, and partners. We facilitate sales and rentals of artworks but are not the original creator or owner of the works. Each artwork is provided by the respective artist, and ArtInsight presents and facilitates its sale or rental on the Site.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to purchase, rent, or apply through the Site.

3. Artworks, Availability & Pricing

Most artworks are original, one-of-a-kind pieces, so availability is limited to a single unit. All prices are displayed in Armenian Dram (AMD) and are subject to change without notice. We make reasonable efforts to display works, colors, and dimensions accurately, but slight variations may occur.

4. Purchases & Payment

When you place an order, you make an offer to purchase the selected work. Payment is processed in AMD through our payment provider, [payment provider, e.g. Ameriabank / Idram]. The sale is facilitated between you and the artist through ArtInsight. An order is confirmed only once payment is received and we have confirmed availability.

5. Shipping & Delivery

Delivery arrangements, timelines, and costs are agreed on a per-order basis. Shipping within Armenia and internationally may be available; any customs duties or taxes are the responsibility of the buyer. Risk in the work passes to the buyer upon delivery.

6. Returns & Cancellations

Because artworks are original and unique, all sales are final and non-refundable, except where a work arrives damaged or materially different from its description. Any claim must be reported within [7] days of delivery with supporting photographs.

7. Rental Service

ArtInsight offers artwork rental as a separate service for offices, hospitality, and other spaces. Rentals are arranged on an inquiry basis and are governed by a separate rental agreement covering duration, fees, installation, insurance, and return conditions. Submitting a rental inquiry does not create a binding rental contract until a separate agreement is signed.

8. Artist Applications & Submissions

Artists may apply to have their work presented on the Site. By submitting an application, you confirm that you own or control all rights to the works and images you submit, and you grant ArtInsight the right to display, promote, and facilitate the sale or rental of those works. Submitting an application does not guarantee acceptance, and ArtInsight may accept or decline any application at its discretion.

9. Intellectual Property

All content on the Site — including images, artwork photographs, text, graphics, logos, and design — is owned by or licensed to ArtInsight and its artists and is protected by intellectual property law. All images on the Site are original photoshoots of our artists’ works. No content may be copied, downloaded, reproduced, or used for any purpose without our prior written permission. No license to any work or image is granted unless and until you purchase the corresponding artwork.

Upon purchase, you acquire ownership of the physical artwork and may keep, display, or resell it. Unless expressly stated in writing, purchase of a work does not transfer the artist’s copyright or reproduction rights in the work.

10. Leads & Inquiries

Information you submit through contact, rental, or collaboration forms is used to respond to your request and, where relevant, to connect you with the appropriate artist or partner, as described in our Privacy Policy.

11. Prohibited Use

You agree not to misuse the Site, including by copying or scraping content, attempting to gain unauthorized access, uploading harmful code, or using the Site for any unlawful purpose.

12. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for their content or practices.

13. Disclaimers & Limitation of Liability

The Site and its content are provided “as is” without warranties of any kind. As an intermediary, ArtInsight is not liable for disputes arising directly between artists and buyers, though we will make reasonable efforts to assist. To the maximum extent permitted by law, ArtInsight’s total liability arising from your use of the Site is limited to the amount you paid in the relevant transaction.

14. Indemnification

You agree to indemnify and hold ArtInsight harmless from any claims or damages arising from your breach of these Terms or misuse of the Site.

15. Governing Law

These Terms are governed by the laws of the Republic of Armenia. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Yerevan, Armenia.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
